Conditions for seaport operation service business

Under the provisions of Decree No. 37/2017 / ND-CP (amended by Decree 147/2018 / ND-CP), enterprises wishing to provide seaport exploitation services must be established in accordance with the law. Enterprise law and fully meet other conditions of the law, specifically as follows:

  1. Conditions on organizational structure and human resources:

Regarding organizational structure: Enterprises are required to have a maritime security management unit as prescribed.

On human resources: all seaport security officers of enterprises must be trained, trained and certified in accordance with the regulations of the Minister of Transport in accordance with the International Code of Ship Security. and the harbor (ISPS Code).

  1. Conditions on material foundations and equipment:

Enterprises must have adequate material facilities, warehouses, yards, and necessary equipment in accordance with national technical regulations applicable to seaports.

In cases where a seaport does not have enough depots and yards, the port enterprise must have a warehouse or depot lease contract (except for cases of operating only wharves, anchoring areas, transshipment areas, and offshore petroleum ports).

In addition, businesses must also meet the conditions of occupational safety and sanitation, and conditions for fire safety in accordance with the law.

  1. Conditions for environmental protection:

Enterprises must ensure adequate means of receiving and recovering wastes from ships when operating at seaports for handling according to the provisions of the International Convention on the prevention of environmental pollution caused by ships. Vietnam is a member (MARPOL Convention) and other conditions for environmental protection in accordance with the law.

In addition, for foreign-invested enterprises, if the enterprises wish to provide container loading and unloading services of maritime transport support services, foreign investors may contribute capital according to the provisions of law. the law. In particular, the capital contribution ratio of foreign investors must not exceed 50% of the charter capital of the enterprise.
