Regulations on leasing bonded warehouses

1. Subjects allowed to rent bonded warehouses:
Currently, according to regulations, subjects allowed to rent bonded warehouses include:
• Vietnamese organizations and individuals are allowed to import and export business of all economic sectors.
• Foreign organizations and individuals.
2. Regulations on bonded warehouse lease contracts:
In the procedure of bringing goods into bonded warehouses, it is impossible to lack the provisions on bonded lease contracts as follows:
• Bonded warehouse lease contract will be agreed by the bonded warehouse owner and the shipper. Except for goods owners and bonded warehouse owners.
• The validity period of the contract and the term of the bonded warehouse lease shall be agreed upon by the shipper and the bonded warehouse owner. However, this time will not exceed the time for goods to be bonded in accordance with Clause 1, Article 61 of the Customs Law.
• In case the lease term of the bonded warehouse expires in accordance with Clause 1, Article 61 of the Customs Law. If the goods owner or the person authorized by the owner of the goods does not take the goods out of the bonded warehouse. Or during the term of bonded warehouses, but the goods owner or the person authorized by the owner of the goods has a written request for liquidation, the Customs Department shall organize the liquidation of the goods deposited in the bonded warehouse according to the provisions of law.
Services available in bonded warehouses
When the owner of the goods conducts the shipment to the bonded warehouse, he/she will directly perform or authorize the bonded warehouse owner. Or agents to carry out customs procedures to perform the following services for goods stored in bonded warehouses:
• Reinforcement, package division, packaging; grafting goods; Classification of products for goods and goods maintenance.
• Taking samples of goods to serve management or customs procedures.
• Transfer of ownership of goods.
Procedures for bringing goods into bonded warehouses
Procedures for bringing goods into bonded warehouses include the following steps:
• For goods from inside or outside, from the non-tariff area to bonded warehouses. Then the goods owner or the person authorized by the owner of the goods must carry out the procedures for importing the bonded warehouse at the Customs Sub-Department managing the bonded warehouse.
• For goods brought from bonded warehouses to foreign countries or inland, from non-tariff areas. Then the goods owner or the person authorized by the owner of the goods must declare the information of the bonded warehouse goods with the Customs Sub-Department managing the bonded warehouse.
• In the case of imported goods into the Vietnamese market, customs procedures must be carried out as for goods imported from abroad according to the corresponding type of import. The time of actual import of goods is the time when the customs office confirms that the goods are removed from the bonded warehouse.
• Goods sent in bonded warehouses subject to re-export under decisions of competent state management agencies are not allowed to be re-imported into the Vietnamese market.
• For goods transported from import border gates to bonded warehouses; goods from bonded warehouses to export border gates; goods brought from inland to bonded warehouses and vice versa must go through customs procedures like for goods transported under customs supervision. Except for goods that have exported procedures from inland or goods when carrying out procedures for importing into the inland, the combined shipping declaration forms have been opened.
• All customs procedures, customs inspection and supervision of exported goods, imported into bonded warehouses as well as the handling of unsold goods. They will be guided by the Minister of Finance.
